Incarceration For The Mentally Ill Offenders By Providing...

Memo to the Mayor Mental health courts are courts specifically dedicated to offering an alternative option to incarceration for the mentally ill offenders by providing treatment options. The idea of mental health courts is noble, one should not view only the benefits but also the possible detrimental impacts they could have on the public before providing funding. One can only make an informed decision on the merits of mental health courts funding when they weigh the benefits recidivism rates, public safety, equality for the mentally ill against the detrimental effects such as reintegrating convicts back into society, promotion of medicalization of deviance, and the possible unnecessary arrests. One of the primary benefits mental health courts offer is public safety. This becomes clear upon examining mental health court alumni’s rates of recidivism. Alumni of mental health courts where â€Å"4.1 times less likely to re-offend† according to a 2004 study completed by Heidi Herinckz of Portland State University (â€Å"A new justice system† 2005). In addition the study found a 62 percent drop in probation violations among the 368 cases followed. One could reason that, should mental health courts maintain similar numbers to those in the study above, the reduction in repeat crimes will result in greater public safety. Greek Mythology and Perseus free essay sample

Perseus King Acrisius of Argos has a stunningly beautiful daughter but wants a son, so he prays to the gods. Apollo tells him not only that Acrisius will never have a son, but also that the son of his daughter will kill him. The only way to fully prevent this prophecy would be to kill his daughter, Danae, but Acrisius fears what the gods would do to him. Instead, he imprisons Danae in a bronze house without a roof and guards her carefully. Arcisius does not expect, however, that Zeus will come to her and impregnate her. Perseus is born, and after Acrisius discovers the baby, he puts Perseus and Danae in a box and sets it out in the ocean. Luckily (or thanks to Zeus), the box washes up on a small island, where a kind fisherman named Dictys takes Danae and Perseus in. They live happily until Dictyss brother, King Polydectes, falls in love with Danae and decides to get rid of her son. They give him his three gifts: winged sandals, a magic wallet that changes to the size of whatever its contents, and, most important of all, a magic cap that will turn whoever wears it invisible. With Hermes and Athena at his side, Perseus finds and kills Medusa. He puts the head in his wallet and flies, invisible, back toward his mother. On the way, he passes a beautiful woman chained to a rock, Andromeda, and falls in love with her instantly. She was chained there because her foolish mother had thought herself more beautiful than any goddess, so as punishment the gods told her to chain her daughter to a rock, where she would be eaten by a serpent. Perseus kills the serpent and takes Andromeda home. When he returns to the island, he discovers that Danae and Dictys have gone into hiding because Danae will not marry Polydectes. The evil king, meanwhile, is hosting a banquet with all his supporters. Perseus barges in and holds up the head of Medusa. Unable to look away in time, all the men turn to stone. Perseus finds his mother, makes Dictys king, and marries Andromeda. Optimistic, Perseus and Danae return to Argos to find her father, King Acrisius. They hope that his heart has warmed since he put them in a box out to sea, but when they reach Argos they realize that he fled the land. One day, Perseus competes in a discus-throwing contest. His disc veers far to the side and lands on a spectator in the crowd, killing him instantly. This is Acrisius, in fulfillment of Apollos prophecy. Analysis This famous tale underscores the inescapable nature of fate and prophecies in the course of telling a heros story. Although Acrisius took drastic action to change destiny, short of killing his own daughter he can do nothing to prevent his fate. Perseus is too strong to be kept down and on an island, so it is fitting that his fate is to go on adventures and quests and to be helped by gods. He fits the heroic model of an honorable man overcoming all obstacles to reunite his family and do justice. It is interesting to note that the story does not indicate whether fate or Zeus guided Perseuss box to the island. As in the Creation of Earth, the reader must wonder who is in charge. Is there a difference between fate and Zeus, and if so, what is that boundary? Who controls Zeuss fate? To the extent that Zeus does help Perseus, the story also illustrates the benefits that come with honorable behavior. Zeus, Hermes, and Athena all help Perseus at critical moments, allowing him to successfully complete his missions. Perseus, of course, contributes to his own success as well. Hospitality again proves to be beloved by the gods: Dictys, the fisherman, becomes king. In this way, the story highlights that great people can have humble beginnings. Baucis and Philemon, the most clear examples of humble hospitality, share with Dictys a selflessness that ultimately the gods reward. The gods shower these humble characters with material wealth, but why? If humility and selflessness are important, why would physical wealth be the appropriate reward? Perhaps the answer lies in the context of such physical wealth and what it means to the characters. As Perseus deals with the Gray Women, we see the imaginative nature of Greek mythology. These distinct characters, sharing one eye, all shades of gray, last in the readers mind and expand the universe which the mythology depicts. Moreover, when Perseus actually defeats them, the story underscores the recurring theme of human ingenuity. Perseus, of course, stands as a premiere example of Greek heroism. He overcomes all obstacles to defend his family and exact revenge. He proves honorable and valiant, calm and clever. As he fights for his mothers respect and hopes for his estranged fathers love, he values family and loyalty above all else. Medusa, by contrast, is one of the most famous mythical beings. In her case, it is not beauty but ugliness that causes problems for the observer. She is so terrible that one direct look at her turns a person to stone. Medusa is a direct contrast to the many beautiful characters (Adonis, Narcissus) who appear throughout the tales. In this story, as in other tales of heroes, the Greek myths become adventure tales with unforgettable drama, high stakes, and imaginative characters. Such adventures and quests make eachstory live on throughout time as astounding literature that captures our imagination.

US Presidents Religion According to the Constitution With all the rumors claiming former President Barack Obama was a Muslim, its fair to ask: So what if he was? Whats wrong with having a Muslim president? The answer is: not a thing. The No Religious Test Clause of the U.S. Constitution makes it perfectly clear that voters can elect a Muslim President of the United States or one belonging to any faith they choose, even none at all. In fact, three Muslims are currently serving in the 116th Congress: On November 6, 2018, Michigan Democrat Rep. Rashida Tlaib and Minnesota Democrat Rep. Ilhan Omar became the first Muslim women elected to the House, where the join Rep. Andre Carson, a Muslim Democrat from Indiana. In the general realm of Arab religions, all three Hindus who served in the 115th Congress were reelected to the 116th: Rep. Ro Khanna, (D-California); Rep. Raja Krishnamoorthi, (D-Illinois); and Rep. Tulsi Gabbard, (D-Hawaii). Article VI, paragraph 3 of the U.S.  Constitution states: The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States. By and large, however, American presidents have been Christians. To date, not a single Jew, Buddhist, Muslim, Hindu, Sikh or other non-Christian has occupied the White House. Obama has repeatedly stated that he was and is a Christian. That hasnt stopped his most strident critics from raising questions about his faith and fomenting vicious innuendo by claiming falsely that Obama canceled the National Day of Prayer or that he supports the mosque near ground zero. The only qualifications required of presidents by the Constitution are that they be natural-born citizens who are at least 35 years old and have resided in the country for at least 14 years. Theres nothing in Constitution disqualifying a Muslim president. Whether America is ready for a Muslim president is another story. Religious Makeup of Congress While the percentage of U.S. adults who describe themselves as Christians has been declining for decades, a Pew Research Center analysis shows that the religious makeup of Congress has changed only slightly since the early 1960s. The new, 116th Congress includes the first two Muslim women ever to serve in the House of Representatives, and is, overall, slightly more religiously diverse than the 115th Congress. The number of Congress members who identify as Christian has declined by 3 percentage points. In the 115th Congress, 91 percent of members were Christian, while in the 116th, 88 percent are Christian. In addition, four more Jews, one more Muslim, and one more Unitarian Universalist are serving in the 116th Congress. The number of members who decline to state their religious affiliation increased by eight- from 10 in the 115th Congress to 18 in the 116th Congress. Despite their slight decrease, the number of self-identified Christians in Congress- especially Protestants and Catholics- are still overrepresented in proportion to their presence in the general public. As Pew Research notes, the overall religious makeup of the 116th Congress â€Å"is very different from that of the United States population.† Religions of the Founding Fathers Given the diversity of faiths held by America’s Founding Fathers, the fact that the Constitution places no restrictions on religious affiliation, or lack thereof. In his book â€Å"The Faiths of the Founding Fathers,† historian of American religion David L. Holmes notes that Founding Fathers fell into three religious categories: The largest group, practicing Christians who expressed a traditional belief in the divinity of Jesus Christ. Patrick Henry, John Jay, and Samuel Adams, as well as most of their wives and children fell into this category. The founders who, while retaining their Christian loyalties and practices, were influenced by Deism, the belief that, while God as the creator exists, he or she cannot perform miracles, answer prayers, or play any part in the lives of humans. Patrick Henry - Research Paper Example His Childhood Patrick Henry was born on May 29, 1736 to a Scottish-born planter in Studley in Hanover County, Virginia. Immediately after abandoning farming, a misfortune befallen Henry when their farmhouse caught fire destroying everything they owned. As a result, he opted to take over the management of his father-in-law’s tavern where he got money to study law. He soon got a law license in 1760 after which he began practicing as a lawyer (Raphael, 2004). Politician and Lawyer Henry demonstrated his brilliance a persuasive lawyer soon after beginning his law practice, which made his very famous and reputable lawyer in the entire state of Virginia. This he argued and won a "Parson's Cause" case in 1763, which was meant to change the way church leaders were being paid in the U.S. However, King George III later overturned the la w prompting one of the clergy to sue for back pay thereby wining the case. However, it was Henry’s persuasive argument against the minister’s a move that made the clergy be paid damages. In the case, Henry pointed out high level of royal interference and greed on legal decisions. Martin Luther King Essay I have a dream was one of the most powerful and influential speeches of all time, it not only created the realisation that the Negro was not free, it persuaded that of white people to make a change for the benefit of the African Americans. The African American civil rights movement was creeping forward but two individuals created a greater atmosphere for the reinforcement of the movement, sure William Wilberforce abolished the slave trade for Britain in 1807, and that was just the start, but 203 years later the African Americans are now equal. It took time but nonetheless it happened. In essence the African American civil rights movement was Martin Luther king’s dream, and that dream has come true. Martin Luther King, Jr. was born on January 15, 1929, in Atlanta, Georgia; He was the middle child from a family of five. Growing up in Atlanta, King attended Booker T. Washington High School. An intelligent student, he graduated from Morehouse with a Bachelor of Arts degree in sociology. The bus boycott of 1955 was the first step in king’s revolutionary ideas. The boycott lasted 382 days. After which the Supreme Court of the United States had declared the laws requiring segregation on buses as illegal, Negroes and whites rode the buses as equals. During these days of boycott, King was arrested, but after he was released, he emerged as the Negro leader. King came from a world where he was part of an inferior race, it was this very world that needed to change and martin Luther King Jr was the one to start the changes that would soon shape the world. The bus boycott was just the beginning of his incredible contribution. Martin Luther King Jr then went on to be one of the most influential people among those who changed the world for the better; he died fighting the cause of justice that is now known as the African American civil rights movement. King wanted a better world where his children were not subjects to racial oppression and judged not by their skin colour but by their character and personality, where the coloured man was equal to the white man, Martin Luther king Jr was so inspired and passionate about change to come about, and he started the bus boycott, taking a stand for what was righteous. The fact that Martin Luther was an African American himself was just as much motivation for his actions and dedication to the African American civil rights movement. Martin Luther king Jr understood the pain caused by racial discrimination and through understanding this pain first hand, made him realise that he wanted to make a change and through doing so, started the bus boycott in 1955. Martin Luther king was so inspired to eventually give his most well known speech which is â€Å"I have a dream†, this speech changed the African American revolution and spoke to every person in the world, whether you were a man of colour or not, it still had meaning, he said that we should treat all people equally and not judge someone by the colour of their skin but by the content of their character. He was inspired and became an influential person for many. John Kennedy came from a rich and privileged Irish-American family. Even so, the family had to leave Boston, and move to New York. In Boston, the family had been held at arm’s length by those rich families who saw their Irish background as vulgar and the family’s wealth as lacking ‘class’. The Kennedy’s hoped that the more cosmopolitan New York would allow them to access high society. This introduction to bigotry and discrimination should have given Kennedy some kind of empathetic understanding of what life was like for African Americans. However, the opposite would appear to be true. However, during the presidential campaign and after he was nominated for the Democrats, Kennedy made it clear in his speeches that he was a supporter of civil rights. Some saw the opposition to the 1957 Act as understandable from a political point of view. Others have adopted a more cynical view which is that Kennedy recognised that he needed the ‘Black Vote’ if he was to beat Nixon. Hence why he said in his campaign speeches that discrimination stained America. Kennedy did not exploit the African American civil rights movement as a scheme to gain more votes, Kennedy wanted the African Americans to be equal, so he took their side, He wanted a better world where blacks and whites were equal, through martin Luther king Jr’s dream, Kennedy also had a vision of this dream where everyone was equal. A world where everyone is not equal is hardly a world at all, and john F Kennedy was a supporter of the new world, he was inspired both through getting the black vote and making a change for the better, with a vision of the new world. Kennedy helped shape the world to what it is today with equality and harmony through all individuals no matter what the race or colour or religion. Within the three speeches in which I have chosen to analyse, there are three main techniques that all three speakers use. These techniques help to make the speeches more effective and have a deeper impact. Repetition is a key point throughout all these speeches, in martin Luther king’s speech he keeps repeating about the dream he has â€Å"I have a dream that one day †, The dream is a frame for the future and sets the stage for the rest of the words. Dream is vague aspiration. One day starts to make it specific. This creates an ambience throughout the audience when he begins to share his dream, those words â€Å"I have a dream† is constantly repeated so that the audience remembers his dream, and even today it is a prominent speech. In JFK’s speech he repeats the phrase â€Å"It ought to be possible† he gives examples of what should be possible. â€Å"It ought to be possible for American consumers of any colour to receive equal service in places of public accommodation. †; â€Å"It ought to be possible, in short, for every American to enjoy the privileges of being American without regard to his race or his colour† this helps the listeners and viewers to get an idea of the dream that both JFK and martin Luther king Jr share. He highlights the importance of what is ‘ought’ to be like to be an American. Furthermore all speakers use emotive language, in martin Luther king Jr’s speech emotive language is everywhere, â€Å"One hundred years later, the Negro is still languished in the corners of American society and finds himself an exile in his own land. And so weve come here today to dramatize a shameful condition. † We immediately feel sympathetic to the Negro’s because of the oppression that they face in everyday life, martin Luther king uses emotive language in several occasions within his speech both for effect and to get people to realise how harsh negro’s are treated in society. We preach freedom around the world, and we mean it, and we cherish our freedom here at home, but are we to say to the world, and much more importantly, to each other that this is a land of the free except for the Negroes† JFK says this with passion as he repeats martin Luther king’s dream and message, the negro is still not free regardless of this contradiction wi th the American voice of freedom. They speak of freedom and peace throughout the world yet, the Negro is still not free, Despite contradictory ideas within the American public, they are forced to feel sympathy for the negro because of these words being spoken. Finally the use of personal pronouns within all three speeches. Martin Luther king specifies the Negro as his personal pronoun, the use of the word in his speech is not to offend but to educate that the African American is still not free; he addresses the Negro people in the crowd and the world. â€Å"But one hundred years later, the Negro still is not free. One hundred years later, the life of the Negro is still sadly crippled by the manacles of segregation and the chains of discrimination† But not only does he address these people, the speech is aimed at white people because they are the oppressors, yet martin Luther king decides to address the Negro as his collective, everyone who attended that speech was addressed, martin Luther king used personal pronouns to persuade and win over his audience and he changed and aided the African American revolution for the better. In JFK’s civil rights message he uses personal pronouns to win over and side with the audience members. Negro† and â€Å"American† are the two personal pronouns used the most throughout this speech. These are used so that everyone is included within this speech, and hence everyone can be persuaded that a change is needed because they feel as if JFK is talking to them, the use of personal pronoun within all three speeches is used to persuade and win over the people receiving the speeches. â€Å"I hope that every American, regardless of where he lives, will stop and examine his conscience about this and other related incidents. † This is speaking out to all Americans in a way through the use of a personal pronoun.

The Industrial revolution was a time of drastic change and transformation from hand tools, and hand made items to machine manufactured and mass produced goods. This change helped life, but also hindered it as well. Pollution, such as CO2 levels in the atmosphere, rose, working conditions declined, and the number of women and children working increased. The government, the arts, literature, music and architecture and man's way of looking at life all changed during the period. Two revolutions took place, both resulting in productive but also dire consequences. Before the first industrial revolution, England's economy was based on its cottage industry. Workers would buy raw materials from merchants, take it back to their cottages, hence the name, and produce the goods at their home. It was usually was owned and managed by one or more people, who were generally close to the workers. There was a good worker/boss relationship, which was demolished and destroyed by capitalism. This industry was efficient but the workers productivity was low, making costs higher. The longer it took one person to manufacture a product, the higher the price. Subsequently, goods were high in price and exclusive only to the wealthy people. The year was 1733, the demand for cotton cloth was high, but production was low. This crisis had to be solved or England's economy would be hindered. The answer came from a British weaver, John Kay, who invented and fashioned the flying shuttle, which cut weaving time in half. John Kay was a pioneer and his invention paved the way for numerous inventors. Although at first, many workers didn't accept machines, in fact, many inventions were destroyed, but what was inevitable, couldn't be stopped. The machines had made their way to England, and nothing could stop them. By the 1750's, the industrial Revolution had begun. At first, inventions were strictly limited to cotton weaving. Inventions such as the spinning jenny and the water-powered frame, both of which provided spinning yarn faster, the spinning mule, the power loom and the cotton gin, all helped the manufacture of cotton goods by speeding up the process. Mass production had begun, along with capitalism. Capitalist, people who have their own materials, money and space, bought many machines and stored them in a factory, where hired people worked the whole day manufacturing goods. The factory system had replaced the cottage industry. Mass production made usually expensive items, such as shoes, less expensive and easily affordable by lower class and less wealthy people.

Contracts are often viewed as unnecessary in the eyes of the public. Most people think that they live their lives doing what they want, when they want with little regard for contractual law. In reality, contracts bind the decisions that most people make on a regular basis. By writing this article I will demonstrate the usefulness of contracts and how they relate to everyday life. I also intend to provide a reasonable idea of what would happen if we did not have contracts guiding decisions made. Because without contracts, the law would not know who to rule in favor of should the need arise, which happens on a daily basis all around the world. The basic definition of a contract is an agreement between two or more parties. This definition encompasses a great many things. If you take a look at the life of an average consumer, from the beginning of their day to the end of it, they make decisions based on factors that have been put in place by contracts. Our consumer wakes up in his home, which was bought from K. Hovnanian, a company that is well known for the designing homes and making people’s dream homes come to life. That house was built by contractors. By definition a contractor is a person or firm who contracts to build things. Electricians, carpenters, stonemasons, plumbers, home audio technicians, Sheet-rockers, painters, and floor specialists are all examples of contractors that were involved in making the consumers dream home come to life. However, K. Hovnanian does not have a contract with each of these types of contractors. Instead, they have a contract with a general contractor, who has agreed to hire each of the other types of contractors to complete the work necessary to make the house come to life. Our consumer works out a deal with K. Hovnanian for a certain price, which becomes the binding contract that K.  Hovnanian agrees to build the house for. The trademarks that K. Hovnanian uses to define who they are, is bound to them by a trademark agreement with the United States. According to the Legal Information Institute of Cornell University, A trademark is defined as â€Å"Any word, name, symbol, or design, or any combination thereof, used in commerce to identify and distinguish the goods of one manufacturer or seller from those of another and to indicate the source of the goods. † By registering this trademark our consumer is able to safely say that it is K. Hovnanian they are dealing and not someone who is pretending to be them. Once the home is completed then, the consumer would then bring in a third party, to the agreement: Bank of America. Bank of America has entered into an agreement with our consumer to pay K. Hovnanian for the home built. In turn, the consumer must pay back Bank of America over the next twenty years at a fixed interest rate the amount of money borrowed. This becomes a mortgage contract. According to the Legal information institute at Cornell University, â€Å"A mortgage contract, involves the transfer of an interest in land as security for a loan or other obligation. this is the most common method of financing real estate transactions. The mortgagor in this case K. Hovnanian is the party transferring the interest in land. The mortgagee, Bank of America, is the providing the loan given in exchange security. â€Å"Normally, a mortgage is paid in installments that include both interest and a payment on the principle amount that was borrowed. † Now that our consumer has bought his home and is moving in, a decision is made to buy items for the home that will be necessary for the consumer to live comfortably. Our consumer goes to Kmart and uses their Visa credit card to pay for a number of items such made by brand name companies such as Martha Stewart Living or Craftsman, the bill of sale, otherwise known as the receipt, is an agreement to pay the store for the amount of goods purchased. However, that is only the basics of the idea. The long process of agreements that we do not see and probably do not think about is there is a contract for every minor detail, allowing this transaction to happen. The consumer uses their Visa to purchase these goods up to a pre-determined dollar amount. Therefore, a request was made by the consumer to purchase the merchandise being sold by Kmart using Visa and, in turn an agreement was made with Visa to pay back in due time the amount for the goods purchased, plus interest of course. In turn, Kmart has agreed to honor Visa as per their contract with Visa. They worked out an agreement before hand to accept Visa, which would increase their sales and Visa would be allowed to keep a small percentage of the sale for the ability to use their services. However, to use the services provided by Visa, Kmart must have an agreement with a company that allows them to go beyond their store via electronic communications. The use of services through a company such as Verizon would be necessary. Verizon provides high speed internet as well as telephone services to companies like Kmart to allow them to access outside of the walls of the business. Therefore, Kmart enters into a binding contract with Verizon, for a pre-determined amount of time and a pre-determined amount of money allowing Kmart to use the services Verizon provides. Now that Kmart has the means to reach the outside world, they must purchase equipment, such as MagTek equipment, that would allow Kmart to use the Visa card allowing consumers to make a purchase on credit for goods that Kmart Provides. According to MagTek’s Website, â€Å"MagTek is a manufacturer of electronic devices and systems for the reliable issuance, reading, transmission and security of cards, checks, PINs and other identification documents. † Among the electronic devices, is a magnetic strip reader allowing consumers to use Visa credit cards to make purchases. Kmart also has an agreement with Omnimedia, the owning entity of the Martha Stewart living products, and Craftsman, a company that makes tools for everyday use. This type of agreement is known an exclusive dealing arrangement. According to the Legal Information Institute at Cornell University, â€Å"Exclusive dealing arrangements are, essentially, requirement contracts in which a seller agrees to sell all or a substantial portion of its products or services to a particular buyer, or when a buyer similarly agrees to purchase all or a portion of its requirements of a product or service from a particular seller. This means that Kmart buys all of its tools from craftsman or all of its household items from Omnimedia. The reverse to this, is that Craftsman or Omnimedia may have an exclusive dealing arrangement in which they agree not to sell their products to competing companies or franchises. As you can see, there is much more going on in behind the curtains of a typical day, so that the consumer is able to live their life. These are only a handful of examples of what parts of our lives contracts have an impact on. There are many more out there. The opposite of having a life filled with contracts, is having one without them, which would likely be a life filled with chaos. Imagine the same scenario in the last few pages, but without contracts binding the many parties involved. Our consumer would set out to buy a home which they decide to do business with K. Hovnanian. On a handshake and a smile K. Hovnanian agrees to build the home, but changes things that the consumer specifically said he wanted to alter the price of the home. After a couple of weeks K.  Hovnanian contacts our consumer to let them know that they were able to secure the land, but the price will be higher. Reluctantly, the consumer agrees, after all this is a dream home that is being built. Another two weeks goes by, and K Hovnanian calls and says construction is right on schedule and that the house will be completed within the next couple of weeks. K Hovnanian and our consumer come to an agreement of money and the consumer has his bank give the money to K. Hovnanian as agreed. After a couple of Months of communication silence, the consumer gets agitated and goes to the lot where his house was being built. There is no house and no construction crew. He goes to the location where K. Hovnanian was only to find out they have closed their doors and left. After contacting some sources to find out the whereabouts of K. Hovnanian, the consumer finds out that the company he has been dealing with was not K. Hovnanian at all, just someone taking advantage of people using the K. Hovnanian name to get money for free. The one contract in all of this that our consumer did setup was with Bank of America for his Mortgage, which is now legally binding. The consumer cannot pay the mortgage and therefore his credit gets destroyed because of a failure to pay and a foreclosure on a home he never saw, which makes it so he never had a Visa card to pay for the purchases from Kmart. Because there was no contract, there was no crime. The company doing business as K. Hovnanian was not wrong because there is no copyright or trademark contract protecting the K. Hovnanian name. The struggle to end apartheid in South Africa appears, at the dawn of the twenty first century, to be an aberration of social and world history. Viewed within the context of the pervasive civil rights movement in North America and the abolition of slavery (first in Britain at the beginning of the nineteenth century and followed by America after the Civil War in 1865), apartheid seems like a medieval notion that was imprinted upon modern history; an anachronistic nightmare imposed on civilised society. In a world that had banished National Socialism and seen the back of Stalin, the Immorality Amendment Act (1961) remained a legal statute in South Africa until 1985, making sexual relations between whites and non‑whites an unlawful act under apartheid. Yet the very singularity of apartheid remained a key reason for its longevity: for as long as South Africa could be isolated and swept under the international diplomatic rug the rest of the free world could comfort itself in its li beral attitude to race relations while leaving the citizens of South Africa to play the role of international pariahs. However, as Barber ascertains, â€Å"although western governments continued to criticise apartheid, their criticism was often drowned out by accusations of their hypocrisy.† For the purposes of this study, analysis will take a chronological form, tracking the genesis of apartheid as a political creed to understand how it became a part of the South African way of life. In this way it will be shown how apartheid took so long to be rooted out of the national culture.   Ã‚  Ã‚  Ã‚   The greatest mistake for historians today is to view South Africa from a solely British colonial perspective. It is important to understand that the country had a long and rich social history before the arrival of the British. It was a legacy tainted with taut race relations between the indigenous African tribes and the first settlers, the Boers. Indeed, before the arguments pertaining to apartheid were ever voiced, the British and Boers fought a long war of attrition (1899‑1902) to determine which nation should govern the land that was rich in minerals and therefore important in an economic and strategic sense. Conflict is thus at the heart of the history of South Africa. Like Northern Ireland one should not dismiss the effects of repetitive differences of opinion whereby war and aggravation can become deep rooted within the culture.   Ã‚   The eventual British victory in the Boer War sewed the seeds of the resentment that would ultimately harvest apartheid (apartness). Boers, or Afrikaners as they were known within their own ranks, felt like aliens in their home land, made to speak a foreign language and pay allegiance to a detested foreign power. During the first three decades of the twentieth century Afrikaners felt more alienated than ever with a large wage and lifestyle discrepancy between the English‑speaking South Africans and the Afrikaners. By the end of the Second World War, the Afrikaners were an ethnic group on the verge of revolting. Therefore, when the alliance between the National Party and the Afrikaner Party bore fruit in the way of a unified South African national election victory in May 1948 the result was a reversal back to political ideals that were envisaged in the pre‑British days of the nineteenth century – apartheid being one of several popular ultra‑conservative slog ans used during the preceding electoral campaign. The day after the victory, party leader, Malan declared: â€Å"Today South Africa belongs to us once more. South Africa is our own for the first time since Union, and may God grant that it will always remain our own.† With such a resentful and dislocated background, apartheid was introduced as a means to perpetuate white rule. As a social and political philosophy, it was a backlash against modernity – specifically against the civil rights movement. Traditionally, prejudice thrives on routine and wilts in the face of modernity and the speed with which the North American people vented their disgust at segregation in the Deep South shocked the white leaders of South Africa, not only for the ferocity of the rage against the state but also for the composition of the dissenters, many white, middle‑class and well‑educated. Yet there were distinct and fundamental differences between the South African national experience and that of the USA. Although both America and South Africa were initially colonial countries, the influx of immigrants to the USA was markedly different to the migration of people to South Africa. As New York took over from London as the financial capital of the West after 1918, South Africa remained a predominantly agricultural country. The relevance of this in terms of the perpetuation of apartheid is that while one nation became a melting pot of differing ideologies, religions, races and creeds, the other became entrenched in a formulaic white‑black divide with a history of Afrikaner and British land‑holders dictating policy to a black populace. Apartheid should be viewed as part of a broader policy of deconstruction taking place in post‑war South Africa, all facets tied to the dual desire to keep power from black people as well as moving away from the disapproving gaze of the West. The removal of both the British National Anthem and the Union Jack as cultural symbol (1957), the replacement of UK currency (1961) as well as the referendum (1960) and subsequent formulation of the republic (1961) highlighted the uniquely South African experience, which was designed as a means to create white unity and loyalty to South Africa alone. In this sense, apartheid was strongly tied to Afrikaner nationalism, making it a movement beyond the comprehension and control of the former British colonial masters. â€Å"While there was very little difference between Afrikaners and English‑speakers in their support for white supremacy, residential segregation and migrant labour, English opinion‑formers constantly tried to distance themselves as much as possible from the racial politics of Afrikaner parties. They found the crude expression of racism distasteful and resented being shut out from power.† Political apartheid in South Africa was so durable because it was built upon a well‑founded ideological structure that curbed black influence in all corners of society. Apartheid can be viewed as a pyramid. The first building block was the political obstacles put in the way of black participation in administrative affairs leaving politics to be a whites’ only domain. The National Party next used enforced separation of existing physical communities to perpetuate their rule, followed by the segregation of education and the labour market (black workers were not officially permitted to form trade unions). Not only did the National Party separate black and white communities but they also restricted movement within the country in the same way that Jews were not permitted to travel within Nazi Germany. The formation of the Bantustans (black ‘homelands’) meant that blacks were put out of sight of the white minority rulers giving rise to two completely separate soci o‑economic groups within one sovereign nation. The sum of these measures was to make a law of a loose body of segregation and prejudice methods of divide and rule that were already in place before 1945, making apartheid the most extreme version of institutionalised racism anywhere the industrialised world. â€Å"Segregation doctrine was supplanted by the more dangerous notion ‘separate development.’ This involved the idea that Africans and others should reside, and enjoy citizenship rights, in distinct ethnic homelands. Whereas White supremacy and segregation had involved an explicit racial hierarchy in legislative and political practice, the NP from 1961 was committed to formal equality between groups understood in ethnic terms.† It is a key point to make in terms of comprehending the durability of apartheid. While segregation alone would have ensured white supremacy for a generation, the complete stagnation of educational or vocational opportunity for blacks meant that they were, over successive generations, unable to wrest power from Afrikaner hands. Moreover, the notion of two ideals of citizenship in one country gave the blacks the illusion of self ­ rule even though, in reality, their human rights were worth next to nothing under apartheid.  Ã‚   Of all the installations of prejudice utilised by the National Party to ensure the penetration of apartheid, the restriction of physical movement proved to be the greatest obstacle to long term change. Throughout history, all of the momentous instigators of social change heralded from industrial cities where like‑minded individuals could disseminate information to one another and could meet in secret underground. Paris, Boston and St.  Petersburg are all examples of the role of the modern city as conduit through which progressive ideas might puncture throughout society so as to induce cultural change. In 1948 there were two million blacks located in South African cities compared to six million in the countryside and the great majority of these lived in slums. With the arrival of the Bantustans, the blacks were further constrained in terms of being able to form a coherent opposition to apartheid along the lines of the Black Panther Party in the USA or the NICRA in Northern Ir eland. Clearly, the lack of intellectual, philosophical and political discourse within South African urban centres meant that apartheid was more difficult to dislodge from within than was the case in, for example, French Algeria, South Africa’s closest continental equivalent.    If the period 1945‑1961 is seen as the foundation of apartheid in South Africa, then the years 1961‑1980 should be viewed as the era of ‘high apartheid’, where the NP regime fought against modernity and international opinion to maintain a political system that was at odds with the rest of western civilisation. Acts of state‑sponsored atrocity such as the Soweto Massacre (1976) shocked the world and divided international opinion. In 1966, at the heyday of apartheid during the final year of Verwoerd’s term in office, 1.5 million blacks were kept in reserve who would otherwise have become urbanised and, potentially, radicalised. Yet it should be understood that the international community was compliant in the continuation of apartheid during this time. It has been shown that the blacks within South Africa were powerless to form opposition to apartheid from within. Hope therefore rested with the outside world.    â€Å"Enforcing apartheid required not only a range of oppressive methods domestically: intimidation, abandonment of the rule of law, torture, outright terror including assassination – all these were commonplace in South Africa. But the tentacles of the police state also spread abroad, often assisted by Western intelligence services in ways which infected and compromised the democratic politics of these countries. From the late 1960’s onwards, South African agents were responsible for a series of attacks on anti‑apartheid organisations across the world.† Thus, as the horrors of the Holocaust faded into history and the world became united by satellite communication, the National Party treatment of blacks could only have been perpetuated via external assistance. Although sanctions were imposed and diplomats constantly sent to Pretoria, the police state apparatus was aided by international impotence in the face of extreme racial oppression. Indeed, the nerve centre of apartheid during the era of high apartheid was the South African equivalent of the Gestapo – the Afrikaner Broederband, established by three Afrikaner nationals in 1918. â€Å"The Afrikaner Broederband made the nature of the apartheid administration unique. Most of the country’s leading government members, generals, judges and senior police officers, along with many Church and education officials, operated on the deeply secret level of the AB.† Economic and cultural ties also ensured that key European countries such as Britain and West Germany continued to trade with South Africa, and the illegal arms trade made certain that the AB and hit‑squads of apartheid were always supplied with the tools to guarantee black suppression. In addition, the spectre of the Cold War loomed large over the issue of apartheid. Not only did the USSR divert attention away from the atrocities taking place in South Africa, but the nation was seen, in much the same way as Vietnam, as a key battleground in the spreading of communist theory across the post‑war globe, exacerbated by the rich economic opportunities prevalent in the country. Perversely, the Soviet states supported the liberal racial ideologies of the suppressed black South Africans, fuelled by the extreme anti‑communist stance of all of the NP leaders, who each played a major role in apartheid. â€Å"Apartheid’s phases have been stamped by Afrikanerdom’s great men: Malan preached Afrikaner unity, Strydom the republican ideal; Vorster’s rule was marked by pragmatism and tough security laws; and PW Botha’s era was distinguished by the total onslaught and militarism tinged with reformism.† That the compliance of the international community was a major factor in the continuation of apartheid can be seen through the means via which it was eventually dismantled. The beginning of the end of apartheid was the revised 1984 national constitution, which aimed to highlight existing divides within the nation to split the burgeoning black political parties. The new constitution differentiated between Indians, ‘coloureds’ and whites leaving blacks as the sole focus of racism in South Africa; however, in attempting to woo other ethnic groups the National Party gave explicit encouragement to, among others, the UDF (United Democratic Front). â€Å"The view from below was of a galling piece of political expediency. The new constitution amounted to an admission that apartheid was a failure.† De Tocqueville in the nineteenth century noted that people may endure grievance and abuse only for as long as they feel as if they are powerless to do anything about it. This had certainly been the case in the history of South Africa until the second half of the 1980’s. Yet with the dilution of the ethnic pool over a period of four decades, and the subtle shift in symbolic power from the NP to the ANC, apartheid was ultimately doomed to failure. Conclusion The widespread feeling of isolation was at the root of the perpetuation of apartheid in South Africa. Isolation was first experienced by the Boers and Afrikaners who then transmitted this sense of alienation to the blacks under the guise of apartheid. Isolation was likewise the tactic employed by the international community after the National Party victory in 1948, which further assisted the policy of apartheid. History reports that expulsion from international groups and treaties benefits no‑one but the dictators in charge of the nation that has so offended the free world. The recent examples of Iraq and Zimbabwe highlight the futility of isolation as an international relations panacea to the social ills of the modern world. It is therefore prudent to see apartheid in South Africa as the vision of Afrikaner racists fuelled by international compliance via ineptitude. Apartheid’s longevity was also aided by the presence of communism and the enticing economic climate of South Africa, which ensured that a tougher stance was not taken against the NP. In this way the struggle to end apartheid took the best part of half a century; the greatest surprise was that by 1990 it ended so quickly without recourse to civil war or mass bloodshed.
